These Terms & Conditions (“Terms”) govern your use of the Lndesk hotel website and booking platform (“Platform”). By accessing or using the Platform, you agree to these Terms. If you are using the Platform on behalf of a business, you represent that you have authority to bind that business.

1. Who we are

Lndesk provides hosted hotel websites, booking tools, and related utilities for property owners. Lndesk enables hotels to accept payments and manage reservations, but is not a party to any booking contract between a hotel and its guests.

2. Eligibility & accounts

• You must be at least 18 years old to create an account.
• You are responsible for safeguarding your login credentials and all activity under your account.
• Provide accurate information and promptly update it when it changes.

3. Services

• Hosted hotel website under an Lndesk subdomain or your custom domain (if enabled).
• Booking management and payment integrations (e.g., Razorpay, Lightning Network).
• Optional add-ons, templates, premium features, and partner integrations.

4. Plans, fees & payments

• Subscription fees and add-on charges (if applicable) are billed in advance and are generally non-refundable except where required by law.
• You authorize Lndesk and our payment partners to charge the payment method you provide.
• You are responsible for taxes, government charges, and any conversion/processing fees.

5. Bookings & refunds for hotel guests

• Each hotel controls its own booking, cancellation, and refund policies.
• Guest-initiated cancellations/refunds must be requested directly from the hotel per that hotel’s policy.
• Lndesk does not control hotel pricing, availability, or conduct and is not responsible for disputes between hotels and guests.

6. Acceptable use

• Do not use the Platform for unlawful, harmful, fraudulent, defamatory, or infringing activities.
• Do not attempt to access non-public areas, test security, scrape, or reverse engineer without written permission.
• Do not upload malware or content that violates third-party rights.

7. Content & intellectual property

• You retain rights to content you upload. You grant Lndesk a non-exclusive license to host, process, and display it to provide the services.
• Only upload content you have rights to use; you are responsible for your content.
• The Platform, software, and templates are owned by Lndesk and licensed to you; no ownership is transferred.

8. Domains

• Subdomains under lndesk.com are provided as a service and may be changed for technical or policy reasons.
• For custom domains, you are responsible for DNS, renewals, and compliance with applicable laws.

9. Third-party services

The Platform integrates services operated by third parties (e.g., payment gateways, analytics, maps). Your use of such services is subject to their separate terms and privacy policies.

10. Privacy

Our Privacy Policy explains how we collect, use, and protect personal data. By using the Platform, you consent to our data practices as described there.

11. Availability & changes

• We aim for reliable service but do not guarantee uninterrupted or error-free operation.
• We may modify, suspend, or discontinue features to improve the Platform or for legal/operational reasons, while honoring core obligations during an active paid term.

12. Warranty disclaimer

The Platform is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Lndesk disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of liability

To the maximum extent permitted by law, Lndesk will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill. Lndesk’s aggregate liability arising from or relating to the services shall not exceed the greater of (a) amounts you paid to Lndesk in the three (3) months preceding the claim, or (b) INR 10,000.

14. Indemnity

You agree to defend, indemnify, and hold Lndesk harmless from claims, damages, liabilities, and expenses arising out of your content, your use of the Platform, or your violation of these Terms.

15. Suspension & termination

• We may suspend or terminate access for violations of these Terms, legal requirements, or to protect the Platform.
• You may cancel anytime; cancellation takes effect at the end of your current billing period (if applicable).

16. Governing law & jurisdiction

These Terms are governed by the laws of India. Courts in Sikkim (or another competent court in India, as applicable) shall have exclusive jurisdiction.

17. Updates to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated “Last updated” date. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
